Though this Criminal Misc. Application the applicant has challenged the legality of Order dated 2-9-2009 passed by the Vth Judicial Magistrate, Karachi East, whereby the learned Magistrate while accepting he Report under section 173 Cr.P.C. in Crime No.915/2008 of Police Station Shahrah-e-Faisal under sections 302/337-K/34/512 PPC sent up the case to the Court of Session for trial in accordance with law.<br>
<br>
2. Briefly, one Fero Mal on 11-10-2008 at about 1900 hours reported the murder of his cousin Ameet Kumar at Police Station Shahrah-e-Faisal by unknownpersons resulting in F.I.R. No.781/2008 under section 302/34 PPC. On 14-10-2008 at 2000 hours yet another F.I.R. bearing No.794/2008 under section 203/34 PPC in respect of same incident was lodged by one Bhagwan Das showing one Kishan Chand (brother of Fero' Mal) and Sabir as suspects.<br>
<br>

It is claimed by Fero Mal that after coming to know that his brother Kishan Chand is required in Crime No.794/2008, he on 3-11-2009 at about 8-00 p.m. produced his brother (Kishan Chand) at Police Station Shahrah-e-Faisal in order to surrender and consequently after preparing memo of arrest he was taken into custody. He further claims that on the same day at about 11-00 p.m. he went to see his brother where he found that his brother was severally tortured and the DSP Incharge (the present applicant) threatened him that if his brother would not confess the murder of Ameer Kumar, he would be tortured to death. On the next day i.e. 4-11-2008 at about 11-30 p.m. he received a telephonic message that his brother had a heart attacked and has been taken to Civil Hospital. When he reached at Civil Hospital, his brother was dead and his dead body contained marks of torture violence caused by the police officers including the applicant during investigation.<br>
<br>

Fero Mal tried to lodged F.I.R. but could not succeed and consequently moved an Application under section 22-A Cr.P.C. which after hearing was dismissed and ultimately on direction of the Honourable Chief Justice of this Court Crime No.915/2008 under section 302/34, P.P.C. was registered against police officers/ officials (including the applicant) allegedly responsible for the murder of Kishan Chand.<br>
<br>

It appears that after preliminary investigation the Investigating Officer proposed the disposal of said crime in 'C' class and such report was accepted by the concerned Magistrate vide order dated 19-3-2008. The record further reflects that after disposal of the said case under 'C' class the complainant sent an application to the Honourable Chief Justice of Pakistan was registered as Human Right Case 1532-S of 2009, wherein the apex Court after taking into consideration the material/documents available on record observed:--<br>
<br>
"It was not a case for the cancellation of the F.I.R. nor the Magistrate should have allowed the cancellation of the same. Therefore, order passed by the Magistrate dated 19-3-2008 is set-aside. Police authorities are directed to proceed against the accused persons on the basis of evidence available on record, they should be challaned in accordance with law. The observations made herein above shall not cause prejudice to them in any manner."<br>
<br>
Consequently, the matter was reinvestigated and a Charge-sheet against the accused of said crime including the application under sections 302/337-K/34, P.P.C. was submitted before the concerned Magistrate who while accepting the report sent the case to the Court of Session for trial in accordance with law.<br>
<br>

Mr. Amir Mansoob Qureshi learned counsel appearing for applicant has contended that the applicant original was charged under sections 316/337-K/34, P.P.C. but on the direction of District Public Prosecutor section 316, P.P.C. was deleted and section 302, P.P.C. was incorporated. Per learned counsel such change of section on the directions of the District Public Prosecutor is not in consonance with law as the District Public Prosecutor had no such authority to direct such change. In support of his contention learned counsel has placed reliance on the case Muhammad Ashraf @ Bhuller v. The State (2008 YLR 1462). It was next contended that the Magistrate is bound to consider all material collected during investigation and then to pass a just, fair and speaking order on a report submitted by the Investigating Officer under section 173, Cr.P.C., whereas perusal of order impugned (whereby case was sent up to Court of session for trial) reflects that neither the material produced was considered nor there was any application of mind through a speaking order, therefore, the same is liable to be set aside. In support of his contention learned counsel has placed reliance on the judgment of the apex Court in the case of Bahadur and another v. The State (PLD 1985) Supreme Court 62, Muhammad Sharif and 8 others v. The State (1997 SCMR 302) and this Court in the cases of Dawood Khan and 8 others v. Ahsan-ur-Rehman and 2 others (2006 MLD 663), Ch. Muhammad Ashraf v. The State 2006 P.Cr.L.J. 518, Muhammad Daiem Shattari v. The State 2007 YLR 2038 and Muhammad Aslam Khan v. The State (2007 MLD 1247).<br>
<br>

On the other hand, learned APG assisted by Mr. Shaikh Jawed Mir, counsel for the complainant, while supporting the impugned order has contended that under section 9 of the Sindh Criminal Prosecution Service (Constitution, Functions and Powers) Ordinance, 2006 (hereinafter referred to as "Ordinance 2006") a report under section 173, Cr.P.C. is to be submitted through Public Prosecutor who is competent to scrutinize the same and empower to direct removal of any defect found therein, consequently, the District Public Prosecutor acted within the parameters of law by issuing direction for removal of the defective provisions and incorporation of the provisions which were made out from the investigation. As to the submission of Mr. Qureshi that the learned Magistrate is bound to consider all material collected during investigation and then to pass a just, fair and speaking order, it was contended that since no harm is being caused to the applicant/accused and his grievance, if any, could be ventilated by the Court of Session as under section 265-D, Cr.P.C., a Court of Session has to consider all martial on the basis whereof an Investigating Officer has based his report, before framing the charge, therefore, the defect, if any has is curable and on such account the impugned order cannot be quashed. It was lastly contended that since the trial Court has taken the cognizance by issuance of N.B.W. therefore, the irregularity, if any, is cured.<br>
<br>
8. I have heard the learned counsel for the respective parties and perused the record as well as case law cited at bar.<br>
<br>
9. Taking up the first controversy regarding changing of section 316 by 302, P.P.C. on the directions of District Public Prosecutor. The scrutiny of record reflects that Investigating Officer upon conclusion of investigation, in his report under section 173 Cr.P.C. proposed prosecution of the accused under sections 316/337-K/34 P.P.C. and submitted the same to the District Public Prosecutor for scrutiny. The Prosecutor upon scrutiny of the material on record vide his Scrutiny Note dated 29-8-2009 gave his opinion which concludes as under:--<br>
<br>
"that sufficient material is available against the accused persons for holding them responsible for Qatl e-Amd of accused under police custody, therefore, I.O. is required to submit report under section 173 Cr.P.C. against the accused under section 337-K/302/34, P.P.C. for approval from the Court."<br>
<br>
The Investigating Officer consequently submitted his report in accordance with the opinion of the Prosecutor.<br>
<br>
10. Before examining the issue it would be beneficial to reproduce section 9 of the Ordinance 2006, which places the responsibility of Prosecution on behalf of the Government upon the Prosecutors:--<br>
<br>
9. Conduct of Prosecution---(1) The prosecutors shall be responsible for the conduct of prosecution on behalf of Government.<br>
<br>
(2) The Prosecutor-General or if so authorized by him, an Additional Prosecutor General shall distribute work to the Prosecutors in the Supreme Court, the High Court, the Federal Shariat Court or a Special Court established under any law for the time being in force.<br>
<br>
(3) A District Public Prosecutor shall distribute work to the Prosecutors with respect to the Courts of Sessions and Courts of Magistrate within a District.<br>
<br>
(4) A port report under section 173 of the Code including a report of cancellation of the first information report or a request for discharge of a suspect or an accused shall be submitted to a Court through the Prosecutor appointed under this Ordinance.<br>
<br>
(5) The Prosecutor shall scrutinize the report or the request and may--<br>
<br>
(a) return the same within three days to the Officer Incharge of Police Station or investigation officer, as the case may be, if he finds the same to be defective, for removal of such defects as may be identified by him; or<br>
<br>
(b) if it is fit for submission, file it before the Court of competent jurisdiction.<br>
<br>
(6) On receipt of an interim police report under section 173 of the Code, the Prosecutor shall---<br>
<br>
(a) Examine the reasons assigned for the delay in the completion of investigation and if he considers the reasons compelling, request the Court for the postponement of trial and in case investigation is not completed within reasonable time, request the Court for commencement of trial; and<br>
<br>
(b) In cases where reasons assigned for delay in the completion of investigation are not compelling, request the Court for commencement of trial on the basis of the evidence available on record.<br>
<br>
(7) Prosecutor may submit to the Court results of his scrutiny in writing as to the available evidence and applicability of offence against all or any of the accused as per facts and circumstances of the case.<br>
<br>
A minute perusal of the aforesaid provision reflects that the conduct of the Prosecution on behalf of Government is the' responsibility of the Prosecutors and every report under section 173 of the Code of Criminal Procedure including the report for cancellation of F.I.R. or discharge of a suspect or an accused has to be filed in Court after the same is scrutinized by the Public Prosecutor and under clause (a) of subsection (5), Prosecutors have the power to return such report to the Officer Incharge of a Police Station or the Investigating Officer if they find it defective for the removal of identified defect. Further more, under subsection (7) the result of such scrutiny as an expert opinion may be placed before the Court for its convenience and consideration of course without any binding force. Even otherwise, the Prosecutor having expertise in the field is in a better position to opine that on the basis of the investigated fact the accused can be tried under a specific provision and in the instant case the fact that the accused persons being officers/official of police cannot be ignored. In view of such clear mandate provided to the Prosecutors, the opinion of the District Public Prosecutor in the instant case totally appears to be in consonance with such mandate and the acceptance thereof by the Investigating Officer followed by changes of section cannot be questioned and holding otherwise would amount to render the provision of section 9 of Ordinance 2006 as redundant. Even otherwise it is ultimately for the Court to decide the provisions with which the accused is charged. Additionally in the instant case the original section with which the accused/applicant was proposed to be charged were also triable by the Court of Session. Consequently, no prejudice could be demonstrated.<br>
<br>
11. As to the case of Muhammad Ashraf (supra) without dilating much it would be suffice to observe that section 9 of the Public Criminal Prosecution Service (Constitution, Functions and Powers) Act 2006 was not brought to the notice of the learned Judge in-Chambers.<br>
<br>
12. As to the second controversy regarding non-application of mind through a speaking order by the learned Magistrate while sending up the case to the Court of session for trial, there appears to be no cavil to the proposition that in cases where the Investigating Officer proposes to terminate/cancel the First Information Report by proposing it to be a "false case" or "case of no evidence" or for any other reason submits report under sections 169/ 173, Cr.P.C., then the Magistrate Incharge in either case whether he concurs or disagree with such report is required to appreciate the report of the Investigating Officer in the light of material collected during the investigation and then to pass just and fair speaking order reflecting judicious application of mind and this is for the reason that by such order the Magistrate endorses termination or decides to take cognizance in a case proposed for termination and in both events either the complainant or the accused have a right to know the reasons which prevailed with the learned Magistrate to endorse termination or to proceed in a case proposed for termination. However, in my opinion in cases where upon completion of investigation the Investigating Officer under section 170, Cr.P.C. on the basis of martial collected during such investigation in his report under section 173, Cr.P.C. proposes the trial of the accused for an offence then such principle is hardly applicable for the simple reason that a Magistrate upon receiving Report under sections 170/173 Cr.P.C. cannot dismiss such report and is duty bound to proceed to deal with it in accordance with law, which means that the Magistrate shall proceed to issue process or send it to the Court of Session for trial, such view of mine finds support from the dicta laid down in the case of Said Jalal and 2 others v. The State and another (1972 SCMR 516). Likewise in the case of Habib v. The State (1983 SCMR 370) the apex Court observed:--<br>
<br>
"If however, a report under section 173, Cr.P.C. shows that the Police Officer has taken action under section 170, Cr.P.C. and has forwarded the accused under custody for trial, the Magistrate shall proceed to take cognizance under section 190(1) (b) Cr.P.C. or send up the case for trial under section 190(3) Cr.P.C." (underline by me to emphasis).<br>
<br>
More so the accused persons neither become remediless in either case i.e. where the Magistrate upon taken cognizance of an offence proceeds to try it or send it up to the Court of Session for its c trial nor looses the presumption of innocence merely for the reason of being sent up for trial as observed in the case of Syed Saeed Muhammad Shah and another v. The State (1993 SCMR 550).<br>
<br>
In the circumstances, I do not find any reason to interfere with the impugned order the application consequently is dismissed.<br>
