CIRCULAR NO.05/2005(A)

SUB:              REMOVAL OF CONTAINERS FROM KICT.

 It has been observed that certain importers / clearing agent approach shipping lines / agents requesting for loose delivery of their cargo actually stuffed as full container load (FCL). The shipping company in order to facilitate their client declares the status of such cargo as LCL in the Import General Manifest (IGM) despite the fact that bill of lading shows its status as FCL cargo.

2.         Resultantly, such importers / clearing agents again approach to Terminal Operators with the request to shift and status their container in KPT area after removal from Terminal. This amendment in IGM and shifting of goods on carious grounds / reasons given by the importer is in conflict with the cargo status declared in the bill of lading and is in violation of provisions of section 43 and 45 of the Customs Act, 1969.

3.         As per section 9 of Customs Act, 1969 KPT is Customs Bonded area. Shipping line or shipping agent cannot change the status of cargo after landing at port. Shipping Agent while filing IGM must ensure that status of the cargo whether FCL / LCL remains as per declaration in the bill of lading until approval of same is accorded specifically by the Customs authorities.
