Clarification Letter to all Collectors of Customs

SUB:              EXPORT OF POL PRODUCTS TO AFGHANISTAN VIDE SRO. 943(I)/ 2007 DATED 14.09.2007.

I am directed to refer to the subject noted above and to say that certain queries have been received in the Board from the Oil Marketing Companies, their associations and the Collectorates as to the implementation of POL SoP notified vide the above SRO. The queries were discussed in a meeting held with the representatives of the stakeholders in the Board on 11.01.2008. As a result, certain amendments in the SoP have been brought about, vide amending SRO_(I)/2008 dated 29-01-2008 (copy enclosed). In order to ensure further smooth implementation of the SoP, the following instructions may please be noted:-

(1)       The subject SRO will take effect on 1st of February, 2008, which implies that it will apply to consignments originating from their respective supply-points on or after 1st February, 2008. The date specified by the Customs Officer in column No.20 of the Application-cum-Transport Permit will be treated as the relevant date for this purpose.

(2)       For the purposes of duty drawback r refund of federal excise duty, or of sales tax against POL exported to ISAF or DESC, the customs authorities may accept the quintuplicate copy of Application-cum-Transport Permit duly endorsed by ISAF or DESC as modified vide the aforesaid amending notification. This is, inter alia, to meet the requirements of the export policy as specified in proviso to para 8(a) of the Export Policy Order, 2007.

(3)       For the purpose of issuance of license and other related issues under this SoP/notification the Collector of Customs (Appraisement) Karachi or Collector Customs (Preventive) Karachi, as may be the practice in vogue in the Custom Origination in respect of exporters/carriers operating or requiring registration at Karachi.

(4)       De-sealed containers or containers found with tampered seals will not be allowed to cross the border.

(5)       The Collectorates are requested to ensure that necessary administrative arrangements at their respective ends are in place before 1st February, 2008 to carry out smooth operation of this SoP.

2.         Compliance report may be sent to the Board.
