STANDING ORDER NO. 01/2006 (A) 

SUB:     Working procedure of Burma Oil Limited (BOML-Container Terminal)

Pursuant to Notifications No. SRO___/2006 and SRO___(I)/2006 dated 07.01.2006 issued by the Central Board of Revenue, Islamabad under Section 9, 10, and78 of the Customs Act, 1969, defining the boundaries of M/s. Burma Oil Limited (BOML) located at 13-Dockyard Road, West Wharf, Karachi, and authorizing them to operate Container Terminal for Less than Container Load (LCL) import/export containerized cargo at Karachi Port only, the following working procedure is laid down to be followed by the all concerned.

2.         That primarily BOML will operate as Custodian of Import and Export of Less than Container Load (LCL) containerized cargo. They will receive LCL containers and effect deliveries of Import and Export cargo and to respective consignees and steamer agents after completion of prescribed Customs formalities. Thus BOML shall be governed by all the relevant provisions of Customs Act, 1969 and other Allied Acts together with departmental Rules and Regulations issued by Central Board of Revenue and Collector of Customs, Custom House Karachi from time to time.

3.         That BOML will furnish a revolving insurance policy from an insurance company duly authenticated by Insurance Corporation of Pakistan to the satisfaction of Collector of Custom, so as to cover the risk of fire, pilferage, theft, robbery, non-delivery, destruction by flood Water, earthquake and/ or any other natural calamities in transit and also during the period the goods are stored in BOML insured party in the policy will be Collector of Customs (Appraisement), Custom House, Karachi.

4.         That BOML will provide sufficient space for de-stuffing and storing of import and export LCL containerized cargo and empty containers. The goods will be stacked index wise leaving enough space between the rows to facilitate inspection and examination of goods by the Customs Staff. A separate cordoned space will be earmarked for examination and storage of examined packages.

5.         The movement of the LCL containerized cargo and from port areas excluding TP, Afghan Transit goods as well as un-accompanied baggage at BOML will be regulated in the following manner:-

i.              The Steamer Agent will file an additional copy of import General Manifest(IGM) wherein goods meant for shifting to BOML will be mentioned in the last sheet along with a request for permission to shift the same BOML.- The Assistant Collector Import will allow the request after his satisfaction that all the legal requirement are fulfilled.

ii.         M/s. BOML will take into custody the LCL containers soon after discharge from the vessels in accordance with the details of containers as recorded in the last sheet of manifest meant for M/s. BOML.

iii.           M/s. BOML will simultaneously request the Assistant Collector (Bond) in Annexure-I to depute an Escort Officer to escort the LCL containers to BOML.

iv.         On receipt of the permission the Assistant Collector of Custom of Respective Wharf/ Shed will depute an examining officer to supervise the handing over of the LCL containers meant for BOML by the representative of the shipping company in the same manner as it is done in the case of Karachi Port Trust (KPT). A tally sheet of the LCL containers will also be prepared giving the seal numbers and any remark, if necessary, in Annexure-Il.

v.            In case any seat is found broken at the time of unloading from the ship, the LCL container shall be re-sealed with the seal provided by The M/s. BOML bearing their own. Serial number and the same fact will be recorded on the tally sheet.

vi.           M/s. BOML will receive the delivery "off the hook” basis. However, arrangement can be made by them with KPT to store the LCL containers at a Place earmarked by KPT in anticipation of Physical removal to BOML.

vii.          The movement of the LCL containers to M/s. BOML will only be allowed through KPT Gate (No. 1 at East Wharf, Lloyd's Gate at West Wharf and main gate from KICT) between 9.00 A.M to 6.00 P.M. However, removal could be allowed round the clock provided M/s. BOML apply to the Assistant Collector of Customs (Import) Appraisement for permission of such removal at least 24 hour prior to actual removal and deposit prescribed overtime fee in advance.

viii.         The list of containers meant for shifting to M/s. BOML will be prepared in quintuplicate for distribution as under:-

ix.           The Exit Gate officer of Customs will tally the LCL container numbers and seal numbers with the list and after keeping his copy of record, will sign the original and duplicate copies of the list and also manifest. The record of gate passes with truck/ trailer numbers will also be maintained at Exit Gate.

x.            On completion of removal of LCL containers from port area to M/s. BOML, a certificate to that effect will be issued by M/s. BOML duly counter signed by the gate Customs Officer and the Escort Officer on the duplicate and triplicate copies of the list of containers as well as the manifest.

xi.           The duplicate copy of the list shall be retained by the gate Customs Officer of M/s. BOML, whereas the triplicate copy will be taken back by the escort officer and submitted to Gate Customs Officer of the respective Exit Gates of KPT/KICT for their record.

xii.          The copy of manifest with endorsement of all concerned will be retained with the in charge Customs Officer of Appraisement Group at M/s. BOML for record and feeding the information in the computer .system for transmitting to IGM control system at Custom House, through an arrangement mutually agreed between M/s. BOML and M/s. Pakistan Revenue Automation (Pvt.) Ltd. (PRAL).       

xiii.         Any mishap or an unforeseen accident, while the LCL containers are in transit, will immediately be brought in writing to the notice of Assistant Collector (Sheds) concerned or the Incharge Customs Operations at BOML who will handle the situation as per Rules and the Incharge Customs Operations at BOML who will handle the situation as per Rules and Regulations based on urgency and nature of problem arising out of each case.

xiv.        Following the de-stuffing of a container, the empty container will be re­sealed by the authorized representative of the container terminal in a manner approved by the Assistant Collector of the container terminal in a manner approved by the Assistant Collector Incharge and a sticker indicating that the container is empty, will be pasted on the face of the container.

xv.          If any empty container is removed out of the premises, the gate Customs Officer will break open the seal and ensure that the container is empty. Re-­stuffing of empty container for export purposes will be done in the presence of the Customs export examination staff, in line with the procedure as practiced in Export Collectorate.

6.         If upon arrival of LCL container at M/s. BOML it is found that the seals of any container is broken or tampered with 100% examination of the container will be carried out in the presence of the representative of M/s. BOML, Customs Examination Staff and the representative of Shipping Company for making detailed inventory of the goods found in the container. Further action in this regard shall be taken as per the provisions of the Customs Act, 1969.

7.         M/s. BOML will issue OUT TURN REPORTS on KPT prescribed format in respect of imported cargo clearly accounting for un-accounted and un-manifested excess/short packages. Such reports will be dealt with by the MCD Section of Custom House with reference to respective IGM in accordance with the existing procedure under the Customs Act, 1969. However, taxes shall be recovered from the Insurance Company through BOML on the missing or short packages, without prejudice to any other action under the law, if it is established that the shortage of goods was due to negligence of BOML.

8.         As regards cases for diminishing of values resulting from damage or deterioration sustained before or during unloading these will be dealt with by the concerned Assistant / Deputy Collector of Customs who shall decide each case on its merits under section 27 of Customs Act, 1969.

9.         Record of goods received and cleared will be maintained by M/s. BOML on register in format per Annexure-lll. The register will be audited every week by the officer In charge of Appraisement work of M/s. BOML. The record should be maintained and saved electronically in the prescribed format, besides its maintenance manually.

10.       Goods Declaration (GDs)/ Bill of Entry (B/E) in respect of imported goods de­stuffed in BOML shall be filed in Customer Service Centre, Custom House Karachi and will be dealt with in the respective Group of Appraisement Collectorate in the usual manner.          

11.       At the time of delivery of the goods, the Customs Officer at BOML will ensure that the duplicate copy of the GD/BE is re-manifested by the Customs Group Clerk at the time of registration. The re-manifestation will be carried out at the fifth copy of manifest.

 12.       In case of Second Appraisement System, the out of Charge officer will be responsible to ensure that the duplicate copy of the GD/ bill of entry is duly manifested by the Customs Registration Clerk before the GD/ bill of entry is finally signed out of charge. However, in case of the first Appraisement the out of charge officer in Custom House will be responsible to ensure that duplicate copy of GD/ bill of entry is duly manifested by Customs Clerk at BOML.

13.       If any imported goods de-stuffed at M/s. BOML are not cleared within 30 days time of the filing of IGM. M/s. BOML will provide the details of such goods to the officer incharge of Customs, who will initiate action in accordance with the provisions of section 82 of Customs Act, 1969.

14.       In case, any difficulty is confronted in implementing the above procedure, it should be referred immediately to the collector of Custom (Appraisement), Custom House, Karachi with all the precise details.

15.       The operation of M/s. BOML shall be registered to Karachi Port and LCL Containerized Cargo only.

 16.       This issues with approval of Collector of Custom (Export).
