It has been noted with concern that the Assessing Officers (AO/PA/AC/DC) keep cases/CRN’s pending unnecessarily for several days before deciding whether to forward the same as a contravention case or adjudication or not. When forwarded for adjudication these contravention cases are often poorly drafted. They do not only lack in legal backing but at times are also faulty in material fact (particulars of the goods) resulting in the case being reverted of corrections. This trend is increasingly leading to delay in finalization of cases apart from causing a negative impact on trade facilitation and expeditious processing which is a hallmark of this collectorate.
2. With a view to ensure that shall CRN’s / cases are attended to the a timely manner; it has been decided that all cases should be acted upon by the relevant assessing officers within 24-36 hours and the matte should not be held up want of action at any stage. It shall be the responsibility of the Incharge Assistant / Deputy Collectors or make sure that no case requiring adjudication proceedings is held up under jurisdiction. The AC/DC concerned will draw out the log at the end of each day before leaving officer to make sure that no contravention case is pending in his/her in-box of any Principal Appraiser / Appraiser. In exceptional cases the reasons for non-submission the contravention report is to be brought to the notice of the Additional Collector concerned for discussion and further course of action, the following day. At the same it will also be the responsibility of the Assistant / Deputy Collector (Group) to procedural' issues raised have been adequately addressed and that the assessment being made is duly supported with legal backing.
