Import and Export Policy of the country requires a certificate from Quarantine Department/ Plant Protection Department/ Marine & Fisheries Department etc. before release/ export of a consignment of food items vegetable seeds fruits etc. The function of collection of such certificates has been entrusted to the Terminal Operator under SRO 704(l)/2007 dated 14/07/2007 covering the PaCCS rules. A review of the existing practice indicates that there is a need to regularly countercheck the certificate that there was collected by the Terminal Operators.
2. In view of the above, it has been decided to streamline the working and ensure implementation of the import and export policy requirements in letter and spirit. Accordingly, the following procedure shall be followed by the all concerned for collection and monitoring of such certificate:--
i. Where a certificate from the Plant Protection/ Quarantine or Marine and Fisheries Department is required for release of a consignment; the “Terminal Operator” shall be responsible for collection of original certificate and matching its particulars with the particulars of the consignment before the release of consignment. If any discrepancy is found, the terminal operator shall report the matter to the Assistant/ Deputy Collector, Incharge of Terminal before release.
ii. All such certificates shall be handed over to the Assistant/ Deputy Collector, Incharge of the terminal on daily basis under proper receipt.
iii. The Assistant/ Deputy Collector, Incharge of the terminal shall be responsible to ensure that all certificates have been received for the consignments released on the day for which a certificate was required.
iv. In case of any discrepancy, he shall take up the matter with the Terminal Operator for accountal.
v. Customs Officers or “AO” (Appraising Officer) designated by AC/DC one mentioned in the certificates to ensure that they are relevant to the consignments.
vi. AC/DC shall send the certificates to the concerned department on weekly basis for verification. In case of any fake/ forged certificates, he shall report the matter to the Assistant Collector Incharge PaCCS examination for initiating action against the importer/ clearing agent under the law.
