OFFICE ORDER NO. 73/2008
It has been noticed that in similar cases, adjudication orders passed by different officers of the Collectorate, divergent decisions are being given. In certain cases, in similar situation, same officer have passed totally different judgments. This state of affairs not only puts the departmental counsels/law officers of the Collectorate on defective before different appellate authorities/ courts but a so creates suspicion about the integrity of the whole adjudication process.
2. The state of affairs is neither desirable nor can be tolerated. Accordingly, all the adjudicating officers are advised to keep harmony in their adjudication orders in consonance with true spirit of law. Henceforth a hard copy of the Order-in-Original is forwarded to the Additional Collector (PaCCS-Law) who will be responsible to submit cases for re-opening under section 195 of the Customs Act. 1969 where orders passed are in violation of the law, policy and procedure immediately.
