STANDING ORDER NO. 04/2009 (A)
SUB: INTRODUCING EXPRESS CLEARANCE FACILITY (ECF).
In order to accelerate the clearance of imports through Model Customs Collectorate of Appraisement, it has been decided to introduce Express Clearance Facility (ECF). This facility shall be extended to the importers listed in the Annex-A of this order. The importers fulfilling the criteria given below may apply for ECF.
CRITERIA FOR EXPRESS CLEARNCE FACILITY:--
a) All the Federal/Provincial Governments, Public Sector Organization and defence imports.
b) Importers registered at Large Tax Payers Unit at Karachi, Lahore and Islamabad, previous ACP Units of the Collectorate or industrial concerns having minimum annual import value of Rs.30 million, on the recommendation of the committee as describe at para 5 of this orders.
c) The facility of Express clearance will be availed only for goodsimported against valid LC (letter of credit) or registered bank contact.
d) This facility shall be withdrawn immediately at any stage if it is found that a case of mis-declaration or fiscal fraud exists or has been detected against the above importer, or a director in case of company firm.
e) Status of importers enjoying this facility shall be reviewed from time to time. If any importer ceases to fulfill the conditions, his name shall be expunged from the list of the importers of Express Clearance.
2. The facility of Express Clearance, however, shall not be availed by the above importers in the following cases:-
a. Where the Goods Declaration is filed prior to the arrival of the vessel under section 79(1);
b. Import of scrap of all kinds, second hand machinery, job lot/ stock lot goods;
c. LCL cargo;
d. Chemical on the controlled list or useable in the manufacturing of narcotics, psychotropic substance or chemical weapons;
e. Items meant for re-export;
f. Banned / restricted items as per current Import Trade & Procedure Order.
g. Items involving Procedural requirements as per Import Policy Order 2008-09.
PROCEDURE FOR EXPRESS CLEARANCE FACILITY:--
a. Names of importers to whom Express Facility is extended shall be maintained in one Customs System.
b. The system shall process the Goods Declaration (GD) made at the time of import by notified importers. The Computer system shall print on the Goods Declaration, “EXPRESS CLEARANCE FACILITY’. All such Goods Declarations where any concessionary SRO or any exemption has been claimed shall be electronically assessed. In case such GDs are not selected by the System for random examination, system shall print, “EXPRESS CLEARANCE FACILITY, - EXAMINATION WAIVED OFF”. The Principal Appraiser Shed shall sign such GDs “out of charge” after verifying the payment of duties and taxes.
c. An Officer not below the rank of Additional Collector on the basis of any credible information may order for examination of any consignment, in case of GDs where examination has been waived off by the system.
d. In cases, where any concessionary SRO or any exemption has been claimed or in case of procedural requirement, GDs selected under “EXPRESS CLEARANCE FACILITY” shall be forwarded to the respective Groups by the System. The Group shall conduct assessment of duties & taxes, verification of exemption and other aspects as required. Principal Appraiser, Shed shall sign “out of charge” such GDs after verifying the payment of duties and taxes.
e. Notwithstanding the aforementioned Facility 10% of GDs of each importer shall be selected at random by the Computer System for examination in order to ensure the correctness of the declarations. Such GDs shall be marked by computer system “SELECTED FOR EXAMINATION UNDER EXPRESS CLEARANCE FACILITY”. The examination shall conduct examination as per examination order issued by the Appraisement Group. In case any discrepancy found during the selected examination, 100% examination shall be carried out. In case of any mis-declaration or contravention of law, proceedings shall be initiated.
f. In case any discrepancies prejudicial to Government revenue or import policy are found during random checking or Post Importation Audit, action would be initiated against the importer or any otherperson involved, in accordance with Customs Act, 1969 and allied laws.
g. The Examining Officer (Exit Gate) shall verify the container and seal number and payment of duty and taxes through computer system before goods are allowed out of customs area. In case of any discrepancy or in case of broken seal, the Examining Officer (Gate) shall mark GD to AC/DC sheds for examination.
3. All GDs processed through “EXPRESS CLEARANCE FACILITY” shall be subject to Post Importation Audit (P.l. Audit). The Principal Appraiser (P.I. Audit) shall mark the GDs to the Appraiser posted in the Section for verification of assessed of duties and taxes. A monthly report shall be prepared by the Assistant/ Deputy Collector (P.L Audit) and submitted to the Additional Collector (P.l. Audit).
4. EXPRESS CLEARANCE FACILITY shall stand withdrawn on detection of any discrepancy or mis-declaration, which shall be sent to the Assistant/Deputy Collector AIB by the person / group / section marking detection. AIB shall maintain profile or the importers and this data shall be fed in the computer system on regular basis.
5. A committee consisting of Additional Collector-I Assistant /Deputy Collector AIB and Assistant /Deputy Collector - Import is constituted to notify or de-notify the importer already notified, and restrict types of import or certain items of import from using ECF, without giving any prior notice to the importer or disclosing the reasons thereof. In case of new applicants of ECF, the committee shall process the application and recommendations to the Collector of Customs.
