Standing Order No.1/2010-Exports
SUB: Express Clearance Facility for Exporters.
In order to facilitate and accelerate the exports clearance through Model Customs Collectorate of Exports, Karachi it has been decided to introduce Express Clearance Facility (ECF) for selected exporters. This facility shall be extended to the selected exporters as per criteria laid down in the succeeding paragraphs and risk management criteria of One Customs Computer System.
Eligibility and Criteria for Export Clearance Facility
a) Exporters registered at Large Taxpayers Unit & Industrial concerns having minimum annual report value of Rs. 450 million or as may be fixed by the Collector (Exports).
b) The Express Clearance Facility shall not be allowed for the following categories:-
i) Scrap of all kind, job lot/stock lot goods.
ii) Consignments without ‘E’ form (Baggage /Gifts/Samples etc.)
iii) Exporters availing scheme of DTRE/Temporary Importation.
iv) Short shipment cases.
v) Banned items, fire arms, explosive etc
c) The ECF shall be available only for specific PCTs of the goods generally exported by the qualified exporters.
d) Status of exporters enjoying this facility shall be reviewed from time to time. If any exporter ceases to fulfill the conditions and criteria as in para 2 of this Order, they shall cease to avail the ECF facility without any further notice. This facility shall be withdrawn immediately at any stage if it found that a case of mis-declaration or fiscal fraud exists or has been detected against any exporter, or a director in case of company/firm.
2. The following procedure shall be observed for export facilitation under ECF.
i). All G.Ds shall be filed on-line through One-Customs Computer System. The exporter shall declare actual quantity along with container count and numbers being exported on G.D. The exporter/clearing agent, shall get print out of GD along with container count and number mentioned thereon. If there is change in the container number, the exporter/C/A shall write the same on the back of the G.D and proceed to the staff of PRAL stationed at the Port/Custom House who shall enter the same in the Computer System. No other amendment shall be allowed without permission of DC/AC. The original G.D, signed by the exporter/CA/duly authorized employee of CA (declared to the licensing authority) showing actual containers/actual quantity being exported shall be submitted to the Customs at the port/terminal.
ii). Short shipment shall not be allowed for ECF.
iii). At the time of Pass-in, the designated Customs Preventive staff posted at the Gate will check container number physically, compare it with declaration on G.D. tick each corresponding container number available in the One Customs Computer System and issue a Gate Pass. The staff shall affix a stamp of “Passed In” on GD, when all containers/packages are passed in to the Port. If full consignment does not arrive within 7 days of the arrival of first part of the consignment, the G.D. shall be cancelled and cargo shall be shutout.
iv) After Passing-in of the consignment at the Port/Terminal, the G.D. shall be registered at the Export Registration Counter manually in the register as well as in the computer system. The status of the consignment selected for ECF by the system shall be informed to the exporter/CA by the registration staff.
v). Such consignment shall be directly marked to the Principal Appraiser by the System and shall not be subject to routine assessment and examination.
vi). The Principal Appraiser shall ensure fulfillment of all procedural requirements (e.g. Phytosantiory Certificate, Animal/ Plant Quarantine Certificate etc.) and payment of due export/ regulatory duty.
vii) The principal Appraiser shall finalize the assessment on the GD as well as in the system. The system shall generate a Serial Number which shall be endorsed on the reverse of G.D by the PA while affixing a stamp of “Shipment Allowed under ECF”
viii) In case the Principal Appraiser has reasons to believe that the consignment needs to be examined, he shall record the grounds and forward the case to DC/AC, who if satisfied with the PA’s observations may change the ECF status and refer the case for examination or assessment, or both.
ix) All other G.Ds shall be processed under normal procedure requiring examination and assessment.
x) Any amendment required after Passing-In of the consignment shall be allowed by the AC/DC. Such consignment shall be excluded from ECF and subject to examination and assessment.
xi) All G.Ds allowed for shipment, duly stamped and numbered by the P.A. Will be forwarded to the Preventive staff as per normal procedure for “Allowing Loading”, including affixation of the stamp. The “Allow Loading” shall also be entered in the Computer System by the Custom staff.
xii) The terminal operator shall allow release of consignment only after verification from one Customs Computer System along with physical inspection of documents. Only those containers shall be released for sailing which have been allowed in the One Custom Computer System by the concerned custom staff.
