OFFICE ORDER NO.19/2015-East 

      In order to streamline the process of clearance under the concessionary regime of Free Trade Agreement (FTA) and to facilitate the speedy clearance of the import consignments, the following procedure may be observed for assessment of GDs where the Certificate of Origin  have been found tampered with/forged:-

(a)  Any certificate of origin found out-rightly fake/forged, would be subject to the provisions of the law and necessary legal prosecution will be initiated against such person and the Custom Agent, in light of Public Notice No. 9/2015 dated 03-03-2015.

(b)  in any certificate if origin if in the column for exporter, name is inserted manually by importer and the Chinese system reflect it blank but all other contents are correct, the importer either has to make full payment of duty and taxes for clearance or submit pay order for assessing the goods provisionally and it would be responsibility of the importer to get the name inserted in the certificate which should also reflect in the computerized system. The same should be done within 30 days of provisional assessment by the importer failing which the pay order will be encashed. 

(c)  In case the name of exporter is not mentioned in the certificate of origin but the labels and marks on the goods reflect name of manufacturer mentioned in the certificate, and all other contents are also correct, the importer either has to make full payment of duty and taxes for clearance or submit pay order for assessing the goods provisionally and it would be responsibility of the importer to get the name of exporter inserted in certificate which should also reflect in their computerized system. The same should be done within 30 days of provisional assessment by the importer failing which the pay order will be encashed.

(d)  This issues with the approval of the Collector.
