CIRCULAR

SUBJECT:     NON-COMPLIANCE OF PUBLIC NOTICES 01/2014 DATED 31.10.2014 AND 09/2013 DATED 03.12.2013 REGARDING FILING TRUE DECLARATION OF GOODS UNDER SELF ASSESSMENT ALONG WITH RELEVANT DOCUMENTS.

            During random scrutiny of import clearance date, it has been observed that certain importers/clearing agents are not uploading all the requisite documents with their goods declaration. Description of goods has also been found to be vague, particularly in those cases where application of correct valuation rulings or classification is based upon the declared description.

2.         In this respect, attention is invited to Public Notice No. 09/2013 dated 03.12.2013 (copy enclosed) whereby it has been categorically communicated to all concerned that filing of incorrect Goods Declaration (GD) w.r.t description, classification (HS Code), declaration of values less than the Valuation Ruling or doing under invoicing through any mode, declaring wrong quantity/UOM and claiming undue exemption etc., attracts penal provisions.

3.         It is, therefore, once again emphasized for the benefit of all concerned that true declaration as required under section 79(I)(a) & (b), read with Public Notices 01/2014 dated 31.10.2014 and 09/2013 dated 03.12.2013, (and any other directions issued by the Customs authorities in this regard for time to time), must be submitted. This compliance on part of the trade will not only reduce dwell time and cost of doing business but also help the Customs authorities in discharging their duties more efficiently and effectively.
