CIRCULAR
In view of the judgment of Honourable Supreme Court dated 04.08.2016 in Danish Jahangir Civil Appeal No. 1469 of 2015, all applications for provisional assessment under Section 81 of the Customs Act, 1969, filed in terms of Para 21 of Saadia Jabbar case, read with above Orders of the Honourable Supreme Court, shall be addressed by the concerned importers to the Collector (MCC Appraisement-East) alongwith the request that the importer has approached the Director Valuation for revision of that impugned Valuation Ruling being older than 90 days, OR a review application has been filed by the importer with the Director General, Directorate General of Customs Valuation in terms of Section 25-D of the Act; as the case may be.
2. On receipt of the request in Assessment Group, the concerned Assistant Collector/Deputy Collector group shall send a letter (Annex-A) to the Directorate General of Customs Valuation for confirmation of the importer’s claim as mentioned above and on receipt of confirmation thereof, the respective Group shall assess the relevant Goods Declaration, provisionally under Section 81 of the Act.
3. Each Assessment Group shall process such cases through a master file and also maintain the record of all these cases in Excel format as per annex-B.
