OFFICE ORDER NO. 01/2017 

                   This Collectorate is in receipt of continuous complaints against the Terminal Operators for adversely affecting the trade on two accounts viz clearance of cargo is delayed as grounding of containers for physical examination is carried out after exhaustion of allocated demurrage free time and secondly illegal charging of demurrages being incurred upon importers due to overstay of cargo on account of delayed discharge from vessel or delayed grounding/arrangement by the respective Terminal Operators. Therefore, in exercise of the powers conferred under Section 203 of the Customs Act, 1969, it is hereby ordered that custodian of authorized customs areas/ terminal/ wharves notified for loading/ unloading of goods in terms of section 9 & 10 of the Customs Act, 1969 read with sub-chapter XIV of Chapter XXI of SRO 450(I)/2001 dated 18.06.2001, falling within the jurisdiction of Model Customs Collectorate of Appraisement (West), Custom House, Karachi, shall not take into account the time taken from Examination Request (ER) message till grounding of containers message while calculating the free time earmarked to the importers for clearance of the imported Goods, failing which stern action would be initiated against the delinquent  as provided for in the Customs Act, 1969 besides depositing the undue amount charged into the Government Exchequer.
