CIRCULAR
Sub: CERTIFICATION REQUIRED FOR IMPORT OF RECYCLED PLASTIC GRANULES AS PER BASEL CONVENTION ENFORCED THROUGH SERIAL NO.53 OF PART-II OF APPENDIX-B OF IMPORT POLICY ORDER, 2016.
Import of Recycled Plastic Granules is subject to certification from exporting country that the granules being exported are free from hazardous substances as defined in Basel Convention. Enforced vide Serial No. 53, Part-II of Appendix-B of Import Policy Order (IPO), 2016. Basel Convention provides that such certificate shall be issued by Competent Authority of the exporting country as provided at sub-Article 6 of Article 2 of the Basel Convention, which defines Competent Authority as ‘governmental authority’. 2. It has been observed that some importers of Recycled Plastic Granules are submitting certificate from their manufacturers or exporters, with the endorsement from Chambers of Commerce of the exporting country for clearance of their goods, which is not in consonance with the provision of Basel Convention.
3. The importers / clearing agents are advised to strictly comply with the provision of Serial No. 53, Part-II of Appendix-B of Import Policy Order, 2016 and provide the certificate from Competent Authority of respective country as provided under the Basel Convention, while filing Goods Declaration for clearance of Recycled Plastic Granules.
4. It may be noted that with effect from 01-09-2017, non-compliance of above legal requirement will entail framing of contravention for confiscation of the consignments in terms of provisions of the Customs Act, 1969 read with IPO, 2016.
