STANDING ORDER NO.8/1980 (PREVENTIVE)

SUB:     Illegal import of banned/ unregistered DRUGS AND Medicines.

Cases have come to the notice of the undersigned where banned/unregistered drugs and medicines were imported by certain unscrupulous importers and the Customs failed to detect and stop such contravention imports.

2.         Attention of all officers of Customs is particularly invited to the provisions of Section 3(a), 3(g), 4, 7, 8, 23 and 33 of the Drugs Act, 1976, read with para 5(6) of the Import Policy Order for strict compliance All allopathic drugs and medicines which are not registered under Section 3 of the Drugs Act,1976 and are not according to the National Formulary are not permissible for import Any such import shall attract the penal provisions under the Customs Act, 1969, the Imports and Exports (Control) Act, 1950, and the Drugs Act, 1976.

 3.         With a view to ensuring the compliance of the above restriction, the following instructions are issued in respect of air drugs and medicine whether as commercial goods or samples or gift or

otherwise: --

a)    Prior release or direct of allopathic, homeopathic, Unani or Aryuvedic drugs and medicine shall not be allowed in any case except for such vaccines which require immediate and constant storage at a particular temperature/atmospheric condition which is not available at the landing/bonded place of importation;

b)    Careful examination of such imports should be carried out and the report should be specific and indicate at least the following/bonded place of importation;

 

i).   Name of the product (both brand of importation;

ii).  Manufacture’s name and country of manufacture;

iii). Size of packing of    the product and State of the goods (i.e. powder, mixture, suspension, granules, cream, injection, tablets, capsules, etc.); and

iv). Quantity imported.

 

c)    The representative samples of each drug/medicine shall be put upbefore the Appraiser and the Principal Appraiser or the S.P.S. Incharge who shall carefully scrutinize the examination report. He shall determine the nature of drugs/medicine under import and if the same happens to be allopathic medicine/drug, he will ensure that the same are not banned type and are duly registered under Section 3 & 7 of the Drugs Act, 1976. Examination from duty under SRO 667(l)/1980 dated 26.06.1980 read with SRO (l)/80dated 22.07.1980, shall be allowed after verification that the drugs are registered under section 7 of the Drug Act, 1976; the medicine/drugs not so registered are leviable to duty. In case of any doubt, the importer shall be asked to get the invoice, attached to the B/E, certified by the local Assistant Drugs Controller for the purposes of permissibility of import. Where deemed necessary, the officers of Customs should draw samples and get the same analyzed in the laboratory.          

 

d)    The Assistant Collector, Terminal I and Terminal II at Karachi Airport, Air Freight Unit, Unaccompanied Baggage Section, Postal Appraisement Departments and Wharves shall ensure that they maintain an updated copy of the National Formulary and all orders / instructions / notifications regarding import of drugs and medicines and keep the same in the aforesaid Units for the ready reference by the officers posted there. The Assistant Collectors shall also ensure that the Special Signature and the impression of Stamps of officials of the Health Department who certify the documents/invoice that are produced before the Customs are held in the respective Units for comparison.

 

e)    The Appraisers / Principal Appraisers / Shift Incharge/ Superintendent / Assistant Collectors / Deputy Collectors Incharge of the Unit shall be personally responsible and accountable to ensure that no allopathic drugs/medicines or contraband goods get cleared in the guise of homeopathic / bio chemic / Unani / Aryuvedic drugs or medicines or herbs or in the guise of chemicals/raw-materials.
