Sub: DECLARATION / ASSESSMENT OF IMPORTED FABRICS

 

In order to check under invoicing and mis-declaration in quality, quantity, weight origin etc. of imported fabrics of various types, special committees have been constituted, CSC, assessing group and the committee, duly assisted by M/s. PRAL, KPT and terminal operators, shall ensure compliance of following procedure for comprehensive examination of consignments of fabrics:-

 

i-             every consignment of fabrics shall be subject to 1st examination.

 

ii-        committees constituted for examination of fabrics shall, in advance, generate consolidated statement of weight as reflected against each index, declared in the IGM as well as auto-recorded by the custodians through gantries / cranes at the time of unloading of container from ships, in CD / floppy diskette from as well as hard copy, and keep said record readily available with them well before filing of GD and examination thereof for the sake of comparison. The statement shall be carefully scrutinized by respective Deputy / Assistant Collector wharves / terminals in consultation with Additional Collector wharves for the purpose of risk profiling and accordingly for detailed examination once such GD are presented to the committees.

 

iii-       in case of non-weighment of containers through gantry / cranes at the time of grounding, weighment shall be done at computerized weighbridge of terminals / wharves under supervision of any of the committee members at the time of delivery and weight, endorsed on GD by examining officer weighbridge for further necessary action.

 

iv-        Custom Service Centre Custom House shall ensure the GDs of fabrics are accepted and manifested with following declaration:-

 

a)    complete  description of fabrics

b)    total gross and net weight for the consignment

c)    grammage per meter / grammage per sqm

d)    mode of packing i.e. in rolls or in bales with total number of rolls per cartoon/ bales.

e)    width and meterage of each quality separately.

f)     density in terms of yarn per square inch of fabric. 

g)    denier of warp yarn

h)   denier of weft yarn

above mentioned particulars shall also be required to be reflected in the commercial invoice. In case of incomplete declaration in respect of above particulars, CSC stall shall not manifest GD and direct the clearing agent to provide / declare complete information. The importers / clearing agents may, however, have the option to request examination of goods under 1st proviso to section 79(1) of the Customs Act, 1969, in case complete information regarding contents and particulars of goods was not available with them.

 

v-      all consignment of fabrics shall be examined by the committees, especially constituted for the purpose. During course of examination, examining staff / committee shall ensure that requisite information in respect of all particulars, as mentioned above, is categorically reflected in the examination report. In this regard, correct determination of denier, density and weight etc. shall be prime focus of committees. In case of any doubt or confusion, the committee shall draw representative samples in presence of clearing agent. The samples shall be forwarded to the custom laboratory for confirmation of the above aspects.

 

vi-      after examination of goods, GD shall be presented to the group for completion. The group shall assess various types of fabrics keeping in view the quality, grammage, meterage and other material particulars are reported by the examination staff / committee. In case of any violations, appropriate action shall be initiated by the group in light of reported violations.

 

2.   In the meantime, M/s. PRAL, in association with KPT and terminal operator, will devise procedure for recording of weighment system which will capture the weights either at gantry / crane or computerized weighment bridges of terminals /wharves. Gross, tare and net weight of each container shall be recorded by the system. Real time transfer of weight data recorded by the terminal operators / KPT computer systems, to M/s. PRAL, shall be ensured by the custodians. M/s. PRAL shall provide online access to KPT / terminal operations for according of weight on real time basis.
