STANDING ORDER. 11/1988 (PREVENTIVE) 

Subject:        CONDONATION OF OMISSIONS OF FORM “A”

The requests for condonation of omissions of forms A or on the B.D itself (for such goods as are not mentioned on form A but are entered in the examination report of the B.D.), shall henceforth be considered by officers not below the rank of an Assistant Collector of Customs.

2.         While allowing such requests for condonation, the Assistant Collector shall ensure that:-

1.    The omissions were bonafide and the passenger applies for its condonation giving reasons for the omission sought to be condoned.

2.    The items omitted were not found concealed in any package or any other item whether declared on undeclared:

3.    The omission were not in respect of goods which were commercial in nature or commercial in quantities:

4.    The passenger's possession (of the items omitted) abroad is established:

5.    The form A, against which condonation of omission is sought, are not sold/purchased ones;

6.    He is satisfied about the reasons given for such omission and that the condonation of omission is not done in a mechanical manner; and

7.    That the provisions of section 205 of the Customs, Act, 1969, fulfiller.

8.    These instructions shall be followed rigidly in all section dealing with baggage.
