SUB: Classification of plastic key- chains and key ring belt clip.
A question arose regarding the classification of plastic key - chain, (also described as plastic key holders) and key ring belt clips. The key holders of key chains with pendant made of plastic consist of a spring type wire wholly made of plastic with two small steel rings on its ends. Some of these key chains or key holders have small pendants like ball point pens etc. with clip to the pen and the key chains to other things. These pendants are also made of plastic except the steel tip of the ballpoint pen refill. Key ring belt clip is evidently made up of two parts one part consists of male position of the belt clip with steel ring to hold keys and the other part consists of female position of the belt clip. The lever tips on the male position of the belt clip are pressed to release key.
The PCT Committee of the Custom House has considered the classification these key chains. The key chains, key holders and key holder belt clips described above are mainly made of plastic. These goods, therefore, derive their essential character from plastic which is their main constituent material. The essential character of these goods is, therefore, of an article of plastic. The packing material and printed labels found with these goods also describe them as plastic key holders belt clips. Ball point and other small items fitted with some types of plastic key holder minor constituents and do not have the essential character to qualify.
It is, therefore, ruled that plastic key chains and key holders, with or without pendants of minor signification such as small ball point pen, and plastic key ring belt clips as described above fall for appropriate classification under heading 39.0H07E of the Pakistan Customs Tariff.
