PUBLIC NOTICE NO.4/1987-(APPRAISEMENT)
SUB: Classification of contact lens cleaner solution artificial eye cleaner etc.
A public Notice no. 14/85 was issued regarding classification of "Ten Tens’’ brand eyeglass cleaner under heading 38.19C08B. Some importers contended that artificial eye cleaner, contact lens-cleaner etc, are also classifiable under heading 38.19 on the basis of classification of aforesaid eyeglass cleaner. The matter been examined and it is found that "Ten Tens" eye glass cleaner is different 1 contact lens-cleaners and contact lens cleaners have been classified under heading 34.02, 33.06 & 38.11 of the C.C.C. Nomenclature depending upon the nature/composition of the products. The extracts of the Compendium of Classification Opinions are reproduced below for the sake of reference.
34.02(7): Cleaning solutions and protein removers, formulated principally for routine cleaning of contact lenses or artificial eyes to remove oils, dust, protein etc. the cleaning solutions consist surfactants, buffering or chelating agents and anti-microbial substances, which serve mainly as preservatives. The protein removers consist of a mixture of sodium chloride use preservatives and sodium edentate. The products are put up in packing for retail sale.
33.06(6): Wetting and lubricating solutions for soft or hard contact le
or artificial eyes, containing wetting, lubricating or viscosity agents (such as polyvinyl, alcohol hydroxyl ethyl cellulose addition to anti-microbial substances used as preservative: sodium edentate, etc.
They are put up in packing for retail sale and are indented applied either direct to the eyes or to the lenses or artificial before insertion to enhance wearing comfort.
38.11(5): Soaking solutions, the essential function of which is to disinfect contact lenses or artificial eyes during the soaking, rinsing storage period. They consist of anti-microbial substance buffering or chelating agents in an aqueous solution and s up in packing for retail sale.
It is, therefore, circulated for the information of all concerned that asses of contact lens cleanse and artificial eye cleansers etc. will be made under heading 34.02, 33.06 and 38.11 depending upon the composition and nature of each p in accordance with the parameters set out in the explanatory notes to C.C.(explained in the compendium of Classification Opinions.
