SUB: CLASSIFICATION OF PX-1000 (TEXT TELL) WITH PX- 40 PRINTER
A question arose regarding P.C.T Classification of PX-1000 (Text Tell) with PX-40 printer which has an electric typewriter key board. The apparatus under reference has a built-in random access memory of 7400 characters which enables it to store 4 to 5 page of text without auxiliary device. It has a window to display the text up to 40 characteristics. This apparatus is used for transmitting coded or un-coded message on ordinary telephone line by combining it with telephone. The message to be sent (from one telephone connection to another) is typed with the inbuilt key board and then the required number is dialed on phones. The socket of telephone adapter located on the back of PX-1000 and mouth piece of telephone are held together and then by pressing a button the text is transmitted to the desired telephone number within 25 seconds where it can be received by similar gadget and may be stored in that gadget. If coded message is sent, PX-1000 not only receives it on the other and but also decodes it. It has a word search technique through scanning. It also performs functions such as 'delete', insert', block', encrypt', and ‘decrypt' with users definable code PX-40, the printer has dimension 6" x 33/4".It produces 40 characters per line print on paper roll. It is connected with PX-1000.
In importers claim classification of this apparatus under heading 84.53 as a computer on the grounds that the product has a CPU, keyboard, printer and a random access memory containing 7400 characters.
The PCT Committee of the Custom House has examined the issue. The mere resemblance of the transmission system with that of digital data processing system as reflected by para (1) page 1346 (a) of Explanatory Notes to CCCN Section XVI as it has CPU, an input and out punt unit, cannot classify the same under heading 84.35 o Pakistan Customs Tariff for the reason that machines which have specific function have been excluded from the scope of PCT heading 84.53 as provided at page 1346 of CCCN. The PCT heading 84.53 does not cover machines, instruments, or apparatus incorporating or working in conjunction with an automatic data processing machine and performing a specific function. Such machines, instruments or apparatus are classified in the heading appropriate to their respective function or, falling that in residual heading. Because the under reference "PX-1000 (Text Tell) and PX-40 (Printer performs specific function of transmitting messages on telephone lines, these fall out of the orbit of PCT heading 84.53.
It is, therefore, ruled that PX-1000 Text Tell and PX-40 Printer which use telephone line for transmission of messages fall for classification under PCT heading 85.13 by virtue of Explanatory Notes to the CCCN Section XVI, page 1425 as a specific function machine.
