PUBLIC NOTICE NO. 5/1989 (APPRAISEMENT)
Sub: Illegal warehousing of goods in the bonded premises
It has been noted that warehousing facilities are being misused to the extent that the customs-duties and other taxes involved and the value of the goods deposited in the warehouses are not being protected as required under the law. The value of the goods and the amount of duties and taxes far exceeds the face value of the license and the sum insured through the insurance guarantees. Similarly, the goods are deposited in the premises which have neither been approved by the licensing authority and nor have they been included in the licensed premises. In fact such goods are liable to seizure and confiscation according to the existing law and procedures.
2. It is thereby notified for the information of all the importers, clearing agents, bonders and officers of the department that in future no goods shall be warehoused in the premises which are: (a) not approved by the licensing authority or (b) not included in the approved map of the premises of the bonded warehouse. The bonders should certify on the in-bond bill of entry that there is a vacant space for storage of the goods in the approved premises and, after including the value of the goods and the taxes leviable thereon, the total value of goods warehoused and the taxes leviable thereon will not exceed the face value of the license or the sum insured through the insurance guarantees. The bonders and the officers posted at the warehouse are also required to ensure that the goods received are in accordance with the description, quantity and quality of the goods as mentioned in the bill of entry/invoice/packing list etc. Any goods found damaged/deteriorated or pilfered shall not be deposited in the warehouses until and unless a prior permission is given by the Assistant Collector (Bonds). If the damage etc. discovered at the time of bond shall be reported to the Assistant Collector (Bonds) the same day or latest by the next working day. Such goods will be stored in a separate demarcated area and their inventory shall be prepared within 24 hours of such report by the E.O concerned. Any damage or deterioration after warehousing of the goods is required within the shortest possible time to the Assistant Collector warehousing of the goods is required to be reported within the shortest possible time to the Assistant Collector (Bonds) by the bonder and the E.O concerned. The bonders are advised in their own interest to keep checking the goods for damage/deterioration on regular basis. Failure to do so may result in action against them under the rules.
3. The officers posted at the bonds are also required to pay visits to the various godowns of the warehouses and shall ensure that all the goods are being stored in proper manner and there is no danger of damage/deterioration or pilferage to the goods. Similarly, they should not allow any shifting, sorting, packing, repacking or manufacturing unless the warehouse keeper produces permission for the same issued by the Assistant Collector (Bonds) on behalf of the licensing authority. The officer posted at the bond will also endure that a list alongwith the photo-copies of the all the into-bond bills of entry pertaining to the goods warehoused are deposited under receipt with the bond section of the Custom House not late than the following day of the warehousing of the goods. Al entries in the relevant registers shall be made by the E.O. In his own hand-writing.
4. All the license holders of various private and public bonded warehouses are also directed that the certified copy of the approved map (demarcating the actual premises and the license issued by the licensing authority, should always be available at the premises of the bond, in the office. This shall be ensured by all bonders and E.Os by the 22.3.1989. In case of non-compliance action may be initiated against such bonders.
5. This supersedes all previous orders on the points covered by this Public Notice.
