PUBLIC NOTICE NO.46/93-(APPRAISEMENT)
SUB: CLASSIFICATION OF TPL-310 TRAPPED PERSON LOCATOR.
It is notified for the information of the trade that product namely TPL-310 Trapped Person Locator is comprised of portable case containing seismic and echoistic sensors with connecting cable, which can bear/sense and communicate the noise / scratches through head phones. The linked-in panel displays the required information i.e. nature and strength of the signal. It is a highly sensitive instrument which can hear noises, crises, knocking, scratching and other nearby in-audible sounds made by Trapped victims of disaster.
The PCT headings 85.18. 85.43. 90.14 & 90.31 were considered for possible classification. The heading 85 18 deals with microphones, loud speaker's sound amplifier etc., the goods having dual mode seismic and echoistic do not confirm to the text of heading 85.18, the heading 85.43 deals with electric machines not elsewhere specified or included. Heading 90.14 deals with direction finding compasses and other navigational instruments. The instrument under reference points out the location of the Trapped person and has no navigational character. The classification under these heading is therefore, ruled out
The item in question detects the vibration crealed/generated by the movement of the Trapped person as well as sound created by his movements, crying etc. As per page No.1530 para-18 of the Explanatory Notes heading 90.31 deals with instruments detecting vibrations and as such by virtue of Rule-4 of the Rules of Interpretation, the instrument in question is correctly classifiable under PCT 9031.8000.
