sub:  CLASSIFICATION OF CASCADE PUMPS MODEL AM-2, MODEL B M I, MODEL B MIL AND MODEL CM-7 

A question has arisen about correct and appropriate classification of Cascade Pumps, Model AM-2 BMI, BMIL and CM-7 etc. The importers claimed assessment thereof in heading 8413.6000 of the PCT, on physical examination these pumps are found to be a compact unit comprising a cascade shaped impeller / rotor, mounted directly on the motor shaft which rotates in the pump housing, rotating of the impeller products centrifugal action, forcing the liquid outwards. The pump of these kinds are also called monoblock pumps due to their compact construction and are defined as centrifugal pumps appropriately classification in heading 8413.7020 of the PCT.

The importers have accepted that pump Model BMI is a centrifugal pump They however, contended that other pump i.e. AM-2, CM-7 and BMIL are not centrifugal pumps but are rotary type cascade pumps correctly classifiable in heading 8413.6000 of the PCT. In order to substantive their contention they produced a catalogue describing these pumps as "peripheral" type and not as cascade pump and have also relied upon past practice of this Custom House, treating such pumps as rotary displacement pumps.

The issue has been examined in Custom House, in detail. Heading 8413.6000 covers rotary displacement pumps which include, inter-alia , (i) Gear pumps (ii) vane (iii), Rotary piston tube pumps, (iv) Helicoidally pumps (Screw pump and V) peristaltic Pumps, as described at page 1160 of the Explanatory Notes to  heading 84.13 (H.S). Cascade pump does not fall in any of the positive above categories of the positive displacement pumps. It is in fact centrifugal pump based on its functional principle.

From the above discussion, it is established that the impugned pumps are principally centrifugal pumps and not the rotary positive displacement pumps as claimed by the importers. Even if the impellers of these pumps are of different shape it will not change the essential character of the pumps as centrifugal pumps. it is therefore, ruled that cascade pumps correctly classifiable in heading 8413.7020.
