PUBLIC NOTICE NO.08/1991 (APPRAISEMENT)
It is clarified for the general information of the importers that Bonded Warehouses are meant for storage of non-duty goods and not for storage of duty paid goods. The duty paid goods are required to be removed by the owner immediately after payment of duty and taxes.
2. It has come to the notice that considerable number of duty paid consignments are lying for long in the Bonded Warehouses which is a contravention of existing law. All such importers whose duty paid goods are lying in the Bonds are directed to remove these goods from the Bonds at once failing which, not only they shall not be allowed further in-bonding facilities but also appropriate action shall be initiated against them under the law.
3. All the licenses are also directed to get all the duty paid goods removed from their Bond premises immediately. Any failure shall be viewed seriously and action shall be initiated against the licensee for contravention of provisions of section 12 of the Customs Act, 1969.
4. In future, duty paid goods shall be removed from the premises of the Bond immediately after payment of duties and taxes. Examiner incharge of the Board and licensee shall report to Assistant Collector concerned, if the goods are not removed immediately after payment of duty.
5. Examiner Bond and licensee of warehouse are also directed to ensure full delivery against an ex-bond B/E i.e. if ex-bonded quantity on B/E is 50 Pkgs; the delivery is to be given of 50 Pkgs and not for 10 or 49 Pkgs at the same time. Delivery of part consignment of the same B/E is totally prohibited.
iii) The Examining Officer posted at the Bonded Warehouses are directed to report all such cases in which duty paid stocks are still lying in the Bonds and cases in which lessquantity has been delivered than indicated on ex-bond B/E within seven days, indicating Bonds name, license No. Name of importer and address etc., hereof for initiation of action against the defaulter and licensees.
