PUBLIC NOTICE NO. 31/1994 (APPRAISEMENT) 

SUB:  INFORMATION REGARDING IMPORTERS / IMPORTED CONSIGNMENT

It has been observed that whenever any information is required regarding the whereabouts or related documents of any importers the clearing agents show their inability to provide the same. It is for the information of all concerned that as per Rule (12) of the Customs Agents (Licensing) Rules, 1971, (SRO IS(1)/71 dated 8.1.1971) the documents relating to any consignment have to be preserved for at least three years.

2.          In pursuance of the above cited provision of the Customs Agents (Licensing) rules, 1971, all the clearing agent license holders are, therefore, advised to preserve the following record of the importers for scrutiny/check of the customs authorities for three years. After the expiry of three years prior permission (N.O.C) be obtained from incharge Assistant Collector of Customs (Recoveries) for destruction/disposal of the same. The list of documents to be prepared is as under:-

i.          Copy of bill of entry.

ii.        Copy of Import authorization, (Import License/Permit) (Annexure-B etc).

iii.       Copy of letter of credit and its amendment, if any

iv.       Commercial Invoice.

v.        Proforma Invoice/Indent/Purchase Order.

vi.       Catalogue / Literature /Test Report or any technical data relating to import goods.

vii.      Name and address alongwith telephone number of the person who delivered the documents for clearance.

viii.    Copy of National Identity Card of the person.

ix.       The copy of partnership deed, Article of Memorandum ofAssociation imported goods.

x.        Any other related document produced at the time of clearance.

3.         All concerned are, therefore, advised to comply the aforesaid and produce the aforesaid information/documents as and when required and shall be made available at anytime to any officer deputed by the appropriate officer. In case of non-compliance action will be taken under the Customs Agents (Licensing Rules, 1971.
