STANDING ORDER NO. 12/1991-(EXPORT) 

SUB:          PORCEDURE REGARDING ACCEPTANCE OF BANK GUARANTEE IN LIEU OF BANK CREDIT ADVICE FOR GRANT OF DUTY DRAWBACK. 

It has been observed that the bank guarantees submitted by the exporters in lieu of bank credit advices (for claiming duty drawback) were not furnished on the format prescribed by the Central Board of Revenue vide  letter No. 3(79) SS (CR) /75 dated 11th June, 1980. To ensure strict compliance Board’s instructions, the following procedure is prescribed in this regard: --

i)             After registration of duty drawback claims and allotment of SR-II numbers the counter clerk will directly deliver same to Bank  Guarantee Cell under proper acknowledgement.

ii)            Bank Guarantee Clerk will submit till claims to the Appraiser Bank Guarantee Cell on the same day for verification;

iii)           Appraiser Bank Guarantee Cell will verify the bank guarantees received to the effect that the same are in accordance with the approved format (copy enclosed). He will affix stamp ‘checked’, initial and forward the same to concerned rebate section;

iv)           Thereafter, the duty drawback claims will be processed in the Section as usual and Principal Appraiser / Assistant Collector Rebate at the time of sanction of claim will accept the bank guarantee. He will also affix stamp “accepted” and will sign on the bank guarantee;

v)            After sanctioning of the claim, the file will be sent to the Bank Guarantee Cell where bank guarantee will be detached and kept it in safe custody in a separate file and the remaining documents will be sent to the Accounts Section for taking further necessary action.

vi)           The Bank Guarantee Cell will be responsible for further processing of the Bank Guarantees i.e. issuance of demands, extensions / renewals and their cancellation. The bank guarantees after cancellation of receipt of bank credit advices would be handed over to the exporter or their accredited representative against acknowledgements.
