PUBLIC NOTICE NO: 12/1997-(APPRAISEMENT)
SUB: CLASSIFICATION OF CBA COLOUR MONITORS.
A dispute of classification of Colour Monitors KOPTEX BRAND MOBELS K" 2001S (20" size) IT- XX01 g25" 9" & 13"size) manufactured by M/S. Sajoo Corporation, S. Korea was referred to PCT Committee for determining its correct classification.
The monitors were classified by Customs as video display monitors and PCT heading 8521.1000 in the light of Custom House Public Notice No; 12/92(A) dated 27.05.1992. the importer claimed assessment as computer monitors under PCT heading 8471.9200 and ultimately approached CBR for a running. The matter was referred by CBR to the World Customs Organization, Brussels for advise regarding correct classification of such monitors. The Harmonized System committee issues detailed guideline giving the distinguishing features between data processing monitors of Heading 8471 and Video display monitors of Heading 8528. As the light of the opinion of the World Customs Organization. The following facts engaged:-
a) The display pitch size or deft pitch for data processing monitors starts at 0.4 cm for medium resolution monitors and gets smaller at the resolution increases. The dot pitch size of the subject monitors is 0.52 mm for 20” monitor. O.65 mm for 25” & 19” monitors and 0.82 mm or 3” monitors.
b) The video frequency (band width) i.e., the number or dots transmitted per second of monitors of Heading 8471 is 15.1HZ greater whereas the hand width of the subject monitors as per manufacturer’s catalogue is 6MHZ.
c) The horizontal scanning frequency of monitors of Heading 8471 varies from 15 to over 1.5 1HZ whereas for video display monitors of Heading 8521, it is fixed at 1506 or 15.7 KHZ. The horizontal scanning frequency of the subject matter monitors is fixed at 5.6.5 KHz.
3. The PCT Committee also observed that the above guidelines have also be incorporated in the 1996 version of Explanatory Notes to the Harmonium Commodity Description and Coding system. *(Now), all future imports, monitors are to be classified strictly in the light on the above stated *(facts).
4. In view of the above observation, PCT committee unanimously opined that the monitor in question are classifiable under PCT heading 8528.1000 as video monitors, his public notice supersedes earlier Public Notice No. 19/92(A) dated 27.06.1992.
