PUBLIC NOTICE NO. 01/1998 - (APPRAISEMENT)
SUB: DETECTION OF EXCESS QUALITY/WEIGHT OF THE IMPORTED ITEMS-INSTRUCTIONS REGARDING.
It has been observed that in certain cases the actual quantity / weight of various imported items like betel-nuts, dates, artificial leather etc. is found in excess than the manifested quantity/weight as shown in the relevant bill of entry and document e.g. invoice and bill of lading etc. all such discrepancies attract penal action/adjudication where the weight recorded in the IGM/Bill of Lading is substantially less than actual weight ascertained op the basis of physical weighment. In order to avoid adjudication and delays. Certain clearing Agent/Importers have now stated declaring actual weight in the relevant columns of the bill of entry in addition/supercession of the weight otherwise declared on import documents.
2. It is clarified for information of all concerned that such declaration through made voluntarily, shall still not absolve the importers/clearing agents from the adjudication proceedings of the actual weight is found more than the manifested weight declared on invoice and bill of lading etc. the shed staff shall refer to the manifested weight declared in the documents viz, invoice, bill of lading, etc, for the purpose of determining percentage of excess weight/quantity. Adjudication proceedings shall however, not be initiated where extent of excess weight is less than 5% of the declared weight in such cases extra duties/taxes shall, however, be assessed.
It is further notified for the information of importers clearing agents and the staff that where such offence of mis-declaration of quantity is repeatedly committed by a same import, more severe action including prosecution be initiated against such habitual offenders.
