PUBLIC NOTICE NO. 06/2000 (APPRAISEMENT)
SUB: Procedure for inter-wharves movement containerized cargo.
In supercession of this Collectorate’s Public Notice No. 8/93 (A) dated: 25.02.1993 and Standing Order No. 4/93(A) dated 02.03.1993, following procedure for inter-wharves movement of containerized cargo is hereby notified for information and compliance by all concerned;-
i) Only those shipping agents shall be allowed to move the FCL [Full Container Load] containerized cargo who are bonafide plot holders at any of the two wharves/Pak Shaheen container yard and other Off-Dock Container Freight Stations (OGFS) or alternatively their stevedores who hold the plots/terminals at any of the two KPT wharves/Pak Shaheen/OCFS.
ii) The Cargo in transit to Afghanistan and Central Asian Republics (CARs) will not be allowed inter wharf movement. However, FCL containers stuffed with Afghan cargo discharged from ships berthing at East/West Wharf may be allowed to be moved under customs escort to the container Train Terminals at East/Wharf.
iii) The FCL container stuffed with cargo destined for Dry Ports under Transshipment permit (T.P) will also not be allowed inter wharf movement. However, Full Container Local (FCL) container stuffed with cargo destined for Dry Ports under T.P which is landed at East/West Wharf may be allowed to be moved to container Train Terminal at East/West Wharf, under Customs, escort.
iv) The open top and flat-bed containers will, however, not be allowed inter wharves movement
v) No container stuffed with Less than Container Load (LCL) cargo of different destinations will be allowed inter wharves movement,
vi) No container with broken seal will be allowed inter whereas movement.
vii) The movement of FCL containerized cargo shall only be allowed through Gate No. 1 at East Wharf and Lloyd’s gate at West Wharf, under Customs escort.
viii) The shipping agent shall make their application to the Assistant Collector of Custom (Appraisement) Wharves on the prescribed format (Annex-A) alongwith copy of bill of lading during office hours with specific declaration that all the original seals affixed by the shipping line are intact.
ix) The application shall be submitted in quintuplicate. First copy shall be retained by the Appraising Staff posted at the respective entry gate. The second copy shall be retained by the appraising staff ported at the respective entry gate. The third copy of the application shall be retained by concerned port authorities after the goods have entered in to East Warf or West Warf or Pak Shaheen CFS, as the case may be. The fourth copy will be kept by the concerned shipping agent for their record. The fifth copy shall be submitted to the: Assistant Collector of Concerned wharf, from where the permission of inter-wharves movement was sought, for release of the undertaking:
x) The appraising Staff posted at the respective exit gate shall verify that the container(s) bears shippers’/shipping lines’ original seal intact, and verify that seal numbers and particulars of the container(s) are as mentioned in the application form. The staff shall also record the date & time of exit on all copies of application form and shall detach first copy their or for record purpose:
xi) The maximum time allowed for a container to reach from exit gate of the wharves of entry gate at wharves/Pak Shaheen is two (02) hours except under circumstances of force measure:
xii) Movement off containerized cargo between wharves and Pak Shaheen and other OCFS, will be allowed between 9:00 a.m. to 6.00 p.m. on working days, except in emergencies and that too after obtaining special permission from the concerned Additional Collector of Customs.
xiii) In case the seals on containers are found broken/tampered with either after the dispatch or at the time of receipt, the respective container(s) shall be examined 100% by the Appraising staff in the presence of KPT or the relevant custodian of the cargo and a representative of shipping agent inside entry gate. An inventory of the goods contained in such containers (s),will be prepared which shall be taken into consideration at the time of processing/examination,
xiv) A revolving undertaking in the prescribed form set out at Annex-B shall be furnished to the concerned Assistant Collector alongwith his first application for inter wharves movement, on a stamp paper of Rs.500/-, binding the shipping agent to pay the whole amount of duty/taxes, fine and penalty, if any, involved on the cargo intended to be removed in case 6f any eventually like damage, pilferage, theft, fire, accident, causing loss to the Government Revenue.
xv) The Assistant Collectors of two wharves shall exchange information in respect of containerized cargo moved from one wharf to the other, on a weekly basis, in the format set out at (Annex-C), so as to ensure that the containerized cargo allowed movement from one wharf has duly reached the other wharf.
xvi) Any violation of this procedure shall be deemed to be the contravention of relevant provisions of the Customs Act, 1969.
2. PROCEDURE REGARDING MOVEMENT OF CONTAINERIZED CARGO AT PAK SHAHEEN AND OTHER OCFS.
The procedure described above is applicable mutates mutinies to movement of containerized cargo at Pak Shaheen and other OCFS with the direction that no containerized cargo shall be allowed to be stored or staked outside their notified premise.
