PUBLIC NOTICE NO. 04/2003-[PQ]
SUB: RENEWAL OF WAREHOUSING LICENSE FOR THE YEAR 2003-2004
The Public Warehousing Licenses issued by this Collectorate shall be renewed in accordance with the requirements specified below. The bonders shall submit their applications for renewal of licenses within 15 days of issuance of this Public Notice.
2. All licenses will be renewed for fiscal year 2003-2004 in the light of previous Public Notice No. 4/2000-(PQ) dated 5.11.2000 read with instructions issued in this. Regard from time to time.
3. Where the applications are no received within the above specified time, It will be presumed hat licensees are not interested in getting their (BHW) licenses renewed. In-bonding facility will cease automatically on the expiry of above mentioned date, in case applications for renewal of licenses alongwith complete documents including valid Insurance Policy and payment receipt of. Establishment Charges are not received in this Collectorate.
4. The documents to be produced by the applicants alongwith renewal applications are:-
(i) Original Warehousing License.
(ii) Map if there is any change in dimension of the approved plan.
(iii) Pay order in favour of the Collector of Customs covering Establishment Charges
Rs.150,000/-
(iv) A comprehensive insurance policy pledged/issued in favour of Collector of customs (Port. Qasim) alongwith original premium paid receipt and certificates of reinsurance by (PIC) and other companies; and duly valid upto 31.7.2004 covering risks of equivalent to 110 percent of the value of license, covering the total amount of duties and taxes (including income tax) involved on the goods to be warehoused should also be submitted alongwith the application.
Note: Insurance policies of those insurance companies will be accepted whose paid up capital is not less than Rs.40 million and there exists no liability against those companies in Port Qasim Collectorate.
(v) Certificate, from the Department of Insurance, Ministry of Commerce, Government of Pakistan confirming the following;
(a) Treaty capacity of the concerned insurance company.
(b) Its re-insurance with any foreign insurance company.
(vi) Certified copy of turnout of the last year of Insurer Company.
(vii) Insurance policy should be duly endorsed and attested by the recognized and reputable insurance surveyor duly registered with the-Government of Pakistan.
(viii) Licenses/Certificates of permission of storage dangerous/inflammable and other goods of required surveyor where required confirming existence of multiple risk for the purposes of insurance.
(ix) Lease/Tenancy agreement for the year 2003-2004 or ownership documents for the bonded premises. In case of bonded warehouses operated in rented premises, if the lease tenancy agreements are silent regarding use of premises as Customs Bonded Warehouse the licensees will produce a separate No Objection Certificate from the owner/landlord for use of the premises as Customs Bonded Warehouse.
(x) An undertaking from the licensee to the effect that, in case of any false declaration in monthly return etc., mishap/damage to the goods not covered by insurance for any reasons they will pay all the duties & taxes leviable, fine and penalties imposed by the competent authority for violation/infringement of any provisions of Customs Act, 1969 and the Rules/Orders issued there under.
(xi) A certificate regarding installation of proper fire-fighting equipment from KMC or Department of Civil Defence.
(xii) An undertaking from the licensees to the effect that they will not mortgage/pledge the bonded goods with the bank or any financial institution for their own purpose. An NOC from the concerned banks for the pledged goods to the effect that customs will not be used in any court if, goods are released on payment of Customs duty and other taxes as per laid down procedure.
(xiii) Bank’s certificate under sealed covers in favour of the Collector of Customs (Port Qasim) regarding sound financial position/fair business dealing of the bonder.
(xiv) (a) Names of the proprietor/Partners/Directors of the firm holding Bonded Warehouse license alongwith their permanent and present addresses, telephone Nos. and copies of NICs.
(b) Names and residential addresses of authorized persons alongwith two photographs of each and copies of their National Identity Card (NIC).
(xv) Income Tax Assessment Order for the last three years.
(xvi) All renewal applications alongwith aforementioned documents for Bonded Warehouses to be deposited in the office of Assistant Collector (Headquarters) Custom House, Port Muhammad Bin Qasim, against proper acknowledgement.
6. Incomplete application or the application not accompanied by the documents, as aforesaid will be liable to outright rejection.
7. The competent authority shall on his satisfaction renew or reject renewal of the Bonded warehouse License on receipt of above referred documents. This however, will be done within a reasonable time limit.
