PUBLIC NOTICE NO.28/2005(A)

SUB:   PROCEDURE FOR ALLOWING PERMISSION FOR PRIOR EXAMINATION BY THE OWNER / AUTHORIZED CLEARING AGENT UNDER PROVISO TO SUB

SECTION 1 OF SECTION 79 OF THE CUSTOMS ACT, 1969.

In order to facilitate the trade and to streamline the working regarding, allowing permission to the owner or his authorized clearing agent for prior examination under proviso to sub-section 1 of section 79 of the Customs Act, 1969, following procedure is prescribed for strict adherence by the all concerned:-

i)          The owner / authorized Clearing Agent shall made a written request to the Assistant/Deputy Collector incharge of respective Group in Custom House under proviso to sub-section 1 of section 79 of the Customs Act, 1969 for examination of imported goods by himself prior to filing of Goods Declaration (GD) by mentioning the detail grounds for making the said request.

 

ii)            The concerned Assistant/Deputy Collector will satisfy himself about the propriety of the request by examining the relevant documents viz contract / letter of credit, purchase order, proforma invoice and letter from shipper indicating reasons to doubt quantity, packing and description of the goods etc. before allowing the requested permission.

 

iii)        To owner / Clearing Agent shall examine the goods himself in the presence of a customs officer specifically deputed to ensure security and intactness of imported contents / related documents and non-pilferage thereof during de­-sealing examination and resealing processes of container / packages etc. The deputed customs officer shall, however, not verify the findings of the importer/clearing agent.

 

iv)        After completion of requested examination, the owner / his authorized clearing agent shall make entry of such goods in goods declaration (GD) himself and file the GD accordingly.

 

v)            Thereafter the GD will be processed as per normal procedure in he concerned group and will also be subjected to examination by the concerned shed staff as per examination order endorsed by the group.

2.         If during subsequent customs examination / assessment process, it is found that correct declaration was not mad by the importers / clearing agent even after having been extended physical examination facility, adjudication proceedings for mis-declaration shall be initiated against the concerned under the relevant provisions of law.
