PUBLIC NOTICE NO. 02/2007III (A)
SUB: Amendments to Public Notice 19/2006-iii (A) dated 19-08-2006,
In order to further streamline the process of cutting/mutilation/denaturing of iron and steel scrap consignments and ensure smooth and expeditious completion of required customs formalities, the following amendments to Public Notice 19/2006-lll(A) dated 19- 08-2006, are hereby notified with immediate effect, for the information of all concerned:
(i) In Para (a), the following shall be added:
The Assistant/Deputy Collector (Assessment) shall allow the importers' request for scraping of serviceable portion of the scrap, the same day. The Customs clearing agent shall, thereafter approach the port authorities/custodian of goods, directly, for fulfilling the required port formalities, and file the GD after completion of the cutting/denaturing process.
(ii) In Para (b), the following shall be added:
The Assistant/Deputy Collector (Assessment) shall approve the importer's request for preparation of inventory, prior to filing of GD, the same day. The importer/Clearing Agent shall present the approval to the Assistant/Deputy Collector-(Shed) within 24 hours, who shall, consequently, appoint an Appraising Officer for joint inspection of the consignment and finalization of the inventory, the same day. In exceptional circumstances, the Assistant/Deputy Collector (Shed) may extend the time for finalization of the joint inventory for 24 hours.
(iii) After Para (b), the following new Para shall be added:
“(ba) In cases where the joint inspection reveals no discrepancy vis-a-vis the restrictions of Import Policy Order, the importers shall forthwith file the GD for completion of required customs formalities. However, in cases where the joint inspection finds violations of IPO requirements, the exact percentage of bona fide scrap and serviceable portions in the consignment shall be ascertained by customs and intimated to the importer, who shall, thereafter, seek the approval of Assistant/Deputy Collector (Shed) for scraping, denaturing of the serviceable portion. The permission shall be given the same day and shall be presented to the port authorities/custodian of goods by the importers for fulfilling the required port formalities. The GD shall be filed after the serviceable portion has been rendered as scrap, by the importers/Clearing Agents”.
