PUBLIC NOTICE OF 13/2007-(A)
SUB: IMPLEMENTATION OF (RULE 302-A OF THE CUSTOMS RULES, 2001).
It is circulated for information of all concerned that in terms of Rule 302-A of Custom Rules, 2001 three samples of imported input goods and output goods meant for export under DTRE Scheme shall be drawn at the time of export respectively in the presence of Assistant Collector incharge of respective wharf / shed. The samples shall be signed by such Assistant Collector or Deputy Collector and DTRE approval number and date shall be endorsed thereon. These samples shall be forwarded to AC / DC (Export) under customs supervision. One of the samples will be retained by the AC / DC (Export) for record whereas the other two will be sent to the Regulatory Sales Tax Collectorate under acknowledgement for necessary action at their end.
2. The Assistant Collector/ Deputy Collector incharge of respective wharf/ shed shall, through the Assistant Collector/ Deputy Collector (Export), inform the Regulatory Sales Tax Collector who issued the DTRE approval about the cases where any discrepancy with reference to the description or other material particulars in respect of input goods imported under DTRE Scheme are different from what has been declared in Appendix-I of DTRE Rules. Notwithstanding anything contained above, the importer/ DTRE user may also be proceeded against under the relevant provisions of law in case of mis-declaration pertaining to input or output goods.
