STANDING ORDER NO.4/1996-(APPRAISEMENT)
It has been experienced that despite repeated attempts, the Appraisement Collectorate has not been able to auction several consignments of confiscated / abandoned goods, the main reason being that the reserve prices (RPs) of these goods were pitched unrealistically on their actual physical condition and applicable duty/tax rates. The quantum of such goods has, over a period of time, increased and its, by all means, impossible to auction them on the present Reserve Prices. Also, with the passage of time, their physical condition has deteriorated and it is apprehended that, if not auctioned at this stage, their physical condition will further deteriorate. Besides, due to continued accumulation of such goods, not only congestion at the Port is escalating, but also the Government is being continuously deprived of the financial gains, which might be accrued from the auction, of these goods. In order to overcome this agnatic situation, the following instructions are issued for immediate compliance.
(i) A Valuation Committee will be setup comprising of the Assistant Collector of Appraisement (Auctions), who will head the Committee, the Principal appraiser of the concerned Examination Shed and one Appraiser of the concerned Appraising Group.
(ii) The Committee will re-examine the consignments under reference, Ascertain their actual physical condition and re-assess the reserve prices keeping in view such factors as:—
(a) present condition of the goods indicating the extent of damage / deterioration, if any, in the quantity of the goods.
(b) extent of depreciation in the value of goods.
(c) period of storage / retention at the wharves since import.
(d) Retaining shell life of the goods.
(e) Whether stored in the Shed (covered area) or in the open.
(f) Current assessable value of identical similar / patchable goods based on CRF etc.,
(g) Current tariff and pay -tariff rates.
(h) Whether the goods attract any general exemption or concessionary rate of duty and taxes under any SRO.
(i) Highest offer in the previous auctions, if any.
(iii) After having appraised the reserve price of these consignments as aforesaid, members of the Valuation Committee including the Assistant Collector (Auctions) will sign the revised RP sheets jointly recording their observations as to the aforesaid factors. These RP sheets 6hall be put up to the Additional Collector (Auctions) on weekly basis for his approval, whereafter the goods, will be subjected to auction as per prescribed procedures.
(iv) The Additional Collector (Auctions) shall personally ensure that the exercise assigned to the said Valuation Committee is completed and goods auctioned on priority basis.
