PUBLIC NOTICE NO.143/2014-ESTT(AW)

SUB:             Delay in process of disciplinary cases 

It has been noticed with serious concern that inquiry proceedings against civil servants under E&D Rules (Sl.No.85) tend to be unduly protracted for various avoidable reasons, causing hardship to the affected officials, on one hand, and defeating the purpose of speedy disposal of cases, on the other.

 2. There are repeated instructions of the government through Establishment Division that disciplinary proceedings be conducted expeditiously. It is, therefore, re-iterated that in all disciplinary cases, in addition to strict observance of the provisions of rule 6 of Government Servants (Efficiency & Discipline) Rules, 1973 (SI. No.85) and standing instructions of the government on the subject, following measures should be strictly observed:-

(a)       All pending inquiries will be completed and submitted to the authorized officer(s) within two weeks from the date of issuance of this order. A time-limit will be prescribed for completion of the inquiry to be assigned to an Inquiry Officer.

(b)       Until the inquiry is completed, the Inquiry Officer, the accused as well as the witnesses concerned will not be permitted to proceed on leave, training course or will be transferred etc.

(c)        A check-sheet, recording the day to day progress, will be maintained by the Inquiry Officer.

(d)       The inquiry proceedings once started should be held without interruption, as far as possible, on day to day basis.

(e)       On receipt of the inquiry, the case will be processed expeditiously by the concerned section of the Collectorate.

(f)        It is impressed upon the Inquiry Officer that the quality of work produced by him will reflect on his efficiency, which will be recorded in his ACR.

(g)       The initiating officer should record his assessment of the Inquiry Officer's performance in the ACR.

 3. A monthly updated statement on Annex  to this order will be submitted to the Collector by 10th of each month by the Additional Collector incharge Establishment Assistant/Deputy Collector (Establishment) will personally ensure that no inquiry remains pending with any inquiry officer without proper justification/approval of the Authorized Officers.
