It is observed that whenever during an examination or an assessment or a post release verification (PRV), any document is found fake/forged tampered, the clearing Agent his authorized person pretends his innocence on the pretext that he/she has submitted the documents whichever provided by the exporter to him/ her and he she was not aware of any forgery or tampering therein.
2. In order to abate the afore-stated practice in vogue. Henceforth the Clearing Agent shall seek either attestation of each document from exporters stating on each document that it is true correct and genuine. Or he/she shall obtain undertaking from the exporter that documents provided by him her/are correct, true and genuine so as to absolve himself herself. In case of any eventuality arises where forgery, tampering or fakeness is found by the department. He/she shall submit the same undertaking or attested documents at time of filing the (II). In absence of such undertaking or attestation, it would be construed that Clearing Agent is in league and collusion with exporter to circumvent the Export Policy Order- 2013 and all other allied prevailing laws and regulations thereof and legal action shall be taken against both the C/A as well along with the exporter.
3. The concerned Clearing Agent shall also present the exporter in person as well as furnish his/her whereabouts as and when required by the Customs, in terms of clause P of rule 101, Chapter VII of Custom Rules 2001 within SRO 450(I)/2001 dated 10.06.2001 failing which he/she would render himself / herself liable to panel action as provided under the law and regulations.
4. The requirement shall be applicable on G.Ds filed on or after 26-10-2015.
