Sub: CLASSIFICATION OF “HAJMOLA TABLETS-DABUR”
The matter of classification of the product, namely “HAJMULA TABLETS- DABUR” was referred by (erstwhile) MCC, Lahore vide letter No.60/ADC/ADJ/HQ/2010/502 dated 12-07-2010 and subsequently, by MCC, PACCS, Custom House, Karachi/Directorate General of Intelligence & Investigation-FBR Karachi in pursuance of Hon’ble High Court of Sindh, Karachi’s Order dated 04-11-2010 in C.P No 2902/2010 to the Classification Centre, Custom House, Karachi.

The product “Hajmola Tablets- Dabur” as per information provided by the importers and literature available on the official web- site of the manufacturer. www.dabur.com/Export-Health%20care-Hajmola, is a tasty digestive tablet that aids digestion, especially after meal. The literature further describes that “Dabur Hajmola” is a mixture of medicinal herb and culinary spices like ‘Nimbu Saar’ (Lemon Extracts) ‘Krishna Lavan’ (Black salt) and ‘Jeera’ (Cummins Seeds)’ sodium chloride etc. available in bottles containing 120 tablets each. The product is claimed to stimulate digestion, eases condition of flatulence, increases appetite, relieves indigestion and is supposed to control dyspepsia. The label pasted on the bottle describes that the product comprises the following ingredients.
“Salt Sugar, Concentrate of Lemon, Black Salt, Cummins seed, Black Pepper, Dry Ginger, Long Pepper, Navsadar.”

The matter was examined by the Classification Committee and after detailed deliberation, classification of the product, namely “HAJMOLA TABLETS –DABUR” was decided under PCT heading 3004.9090 being ‘Ayurvedic Medicine’ by the Classification Centre, Custom house, Karachi vide Public Notice No. 02/2011 dated 02.02.2011. Later the matter was also taken up by the Harmonized System Committee of the World Customs Organization (WCO) Brussels, Belgium in its 53rd session in March 2014 concerning amendments to the Harmonized System Committee after detailed deliberation issued amendments to the Compendium of Classification Opinions. The Harmonized System Committee after detailed deliberation issued amendments to the Compendium of Classification Opinion (page IV/13)and inserted the following classification Opinion ‘concluded that in terms of application of GIRs 1 and 6, the product in question has been declared appropriately classifiable under HS code 2102.90’ The decision of the WCO is reproduced hereunder,
“2106.90 29 Tablets containing salt, sugar, concentrate of lemon, black salt, cumin seeds, black pepper, dry ginger, long pepper and ammonium chloride, put up for retail sale in a container holding 120 tablets. The product is used to aid digestions, especially after a meal. Application of GIRs 1 and 6”
4. The above classification decision of the WCO is mandatory. The goods are therefore, appropriately classification under PCT heading 2106.9090.
5. Public Notice No.2/2011, dated 02.02.2011 issued earlier by this Classification Centre, is hereby rescinded to the extent of classification of “HAJMOLA TABLETS- DABUR”.
