STANDING ORDER NO. 9/2000 (APPRAISEMENT)
SUBJECT: REFUND
It has been observed that refund cases relating to the earnest money/bid amount deposited in auction cases where the bid is not finally approved by the competent authority or is cancelled due to some reason are delayed badly. The delay occurs because of the fact that the refund cases of earnest money or 100% bid money deposited by the bidder is thought to be comparable to refund claims filed under section 33 of the Customs Act, 1969 or the rebate claims filed by the exporters. The case of the refund of earnest money or the 100% bid money deposited by the bidders is, however, different. Once the bid has been rejected by the competent authority, the earnest money or 100% of the bid money deposited by the bidder becomes immediately refundable provided no irregularity or fraud is attributable to the bidders. In such cases the celling limitation of sanctioning powers prescribed in the Standing Order No. 10/98 dated 30.8.98 does not apply and Assistant Collector (Auctions) is competent to sanction the refunds after satisfying himself of the following points, namely: -
a) That the refund application has been filed by the same person who originally deposited the amount:
b) That the bid in the concerned lot has been cancelled by the competent authority;
c) That no irregularity or fraud has been committed by the bidder/applicant, and
d) That the amount deposited has been verified by the bank as well as treasury.
