STANDING ORDER No. 11/2004

SUB:        Expeditious auction / disposal of cargo not cleared within stipulated period at ports/bonds

In order to liquidate the long outstanding cargo, data & record regarding such cargo was Retrieved from the KPT and other custodians and distributed amongst the examining staff for initiation of examination reports and further action. All concerned sections of the Collectorate are directed to duly attend to the data and record and to ensure that the Following measures and taken within their respective jurisdictions for expeditious Liquidation of outstanding cargo:-

(i)         Utilization of available human resource to optimum capacity;

(ii)        sturdy maintenance & keeping of soft & hard updated data;

(iii)       timely& accelerated transmission of soft & hard data    to the next concerned section;

(iv)       Confirmation mechanism for receipted data; record & files;

(i)            Immediate response to the raised queries;

(ii)          meticulous examinations under close supervision of concerned principal appraisers;

(iii)         Meticulous determination of assessable value under close supervision of concerned principal appraisers;

(iv)         Meticulous determination of reserve .price under close supervision of concerned principal appraisers; 

2.         For the above purpose, the procedure as mentioned below is hereby prescribed with immediate effect and till further orders.

i)              the deputy/ assistant collectors, incharge of wharves, terminals, Afghan cargo and bond, shall be incharge of auction in their respective areas of jurisdiction in addition to their existing work. Auction sections, working under the supervision of appraisers at East Wharf, Bond Auction Assistant Section, are placed under the direct control of respective deputy/ assistant collectors at wharves, terminals, and bonds, Deputy/ Assistant Collector, AICT and Afghan Cargo will establish auction see within their jurisdiction accordingly;

ii)       the deputy/assistant collectors at wharves, terminals, Afghan cargo bonds may deploy staff working under their jurisdiction from examination to auction and vice versa keeping in view the requirements of assign at a particular point of time;

iii)         After having sought information at wharves, terminals, Afghan cargo & bonds and files sent directly to the group determination of assessable value. The Customs working in groups be required to determine the assessable value of the lots along checking any other issue relating to importability, law matter, detentions, etc. and shall refer back the file to the respective away sections within three days;

iv)          the respective auction sections, after receipts of the files from the group will calculate the reserve price keeping in view the Board's letter of 15.04.2004 (Annex-I) and accordingly issue fresh schedules to concerned auctions of fresh lots as well as leftovers;

v)               after completion of examination of actionable/ disposable lots, auction files, shall be initiated, processed and completed in accordance with following revised prescribed formats;

(a)        Examination and assessment sheet bearing lot No. Unique identification number (Annex-ll).

(b)      Letter to be issued to the custodians in case of difference of weight quantity & specifications etc. at the time examination viz manifest (Annex-Ill).

(c)                 Note sheet (Annex-IV)

(d)                Letter to be issued to the successful bidder for deposition of 2 earnest money (Annex-V)

(e)                Summary sheet (Annex-VI)

(f)                  Approval sheet (Annex-VII).

vi)            The examination and assessment sheets bearing lot number/ unique identification number shall be treated as Goods Declarations as accordingly, stepwise, fed in the computerized auction management system by all concerned as per the procedure being followed in respect Goods Declaration. The said sheet shall bear "fed in system" code to being affixed such reports at successive steps.

vii)      Wherever required, the issue relating to difference of weight, quantity, description etc. may be taken up with the custodians in the prescribed manner for ensuring transparent and expedient auctions and disposals. 

3.         Deputy/ Assistant Collector, (Auction) shall perform the following functions:-

(a)          He will act as coordinator amongst respective deputy/assistant collectors supervising the work of auction;

(b)          He will receive daily, weekly and monthly auction information from respective auction sections and evaluate such information for determination of further course of action and improvement in the working of respective auction sections;

(c)          He will process& prepare prescribed consolidated daily, weekly and monthly statements, as scheduled, to be forwarded to the Collectorates for onward submission to the CBR; and

(d)       He will develop computerized interface with custodians and Import Section for receipt of automated information in respect of auctionable/ disposable cargo for instant utilization by respective auction sections.

4.         Deputy/ Assistant Collectors concerned are directed to engage in frequent interaction, preferably - weekly with Deputy/ Assistant Collector Auctions and custodians to discuss and deliberate weekly emergent situation and to take administrative measures in view of the feedback from each section/ area and to ensure that  the outstanding auctionable / disposable cargo is liquidated with in stipulated timelines.
